THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.MP.No. 11513 OF 2017 IN/AND CRIMINAL PETITION NO.10379 OF 2017 ORDER:

CRL.P.MP.No. 11513 OF 2017 This petition is filed under Section 320 of Cr.P.C seeking permission to compound the offences punishable under Sections 120(B) and 420 I.P.C r/w Section 34 I.P.C.

The defacto complainant lodged a complaint against the first accused with the police and on the strength of the same, F.I.R was issued. After completion of investigation, charge sheet was filed before the Court for the various offences referred supra. The dispute is with regard to Rs.56,00,000/- and now that the accused paid entire amount of Rs.56,00,000/- to the defacto complainant and settled the dispute amicably.

The defacto complainant and accused are present and they are identified by their respective counsels and produced Photostat copies of Aadhar cards to prove their identity. A joint memo of compromise dated 24.10.2017 is filed, when terms of compromise are explained in vernacular language, they are admitted to be true and correct and when terms of joint memo of compromise are explained in Telugu language, they are admitted to be true and correct. Further, it is now submitted that, both the defacto complainant and the accused voluntarily entered into compromise due to intervention of elders and well-wishers and they wanted to lead peaceful life.

MSM,J CrlP_10379_2017 Therefore, I find that the compromise is voluntary in the interest of both parties and permission is granted to compound the offence. Hence, compromise is recorded in terms of the joint memo filed along with this petition. Accordingly, the petition is ordered. Crl.P.NO.10379 OF 2017 In view of the orders passed by this Court in CRL.P.MP.No. 11513 OF 2017, this petition is allowed. Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
