THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35175 of 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the respondents in not returning the tuition fee of Rs.11,55,000/- paid by the petitioners and the original certificates of the second petitioner and in not considering the representations of the petitioners, dated 05.10.2016, as bad, illegal and arbitrary and consequently to direct the respondents to return the tuition fee of Rs.11,55,000/- and the original certificates of the second petitioner by considering the representation of the petitioners. Heard and perused the material.

Learned counsel for the petitioners submits that initially the second petitioner got the selection in 'B category and as such, deposited an amount of Rs.11,55,000/- as tuition fee. Subsequently, the second petitioner was selected in 'A' category and as such, he made a representation to the third respondent for return the tuition fee already paid by the second petitioner. He further submits that though the petitioners made a representation, dated 05.10.2016, the third respondent has not taken any action on the said representation till date. Considering the facts and circumstances of the case, the third respondent is directed to dispose of the representation, dated 05.10.2016, within a period of fifteen days from the date of receipt of copy of this order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 19.10.2016 pln
