HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29064 OF 2016 ORDER:

Learned counsel for the petitioners submits that the subject matter involved in this writ petition is squarely covered by the order passed by this Court in WP No.33190 of 1997, dated 13-03-2007. 2.

This submission made by the learned counsel for the petitioners, is not disputed by the learned Asst. Government Pleader for Revenue.

In the circumstances, the impugned orders passed by the 3rd respondent and as confirmed by the 2nd respondent in appeal are set aside and the writ petition is disposed of directing the 3rd respondent to receive the document of the petitioners, if it is in order in terms of Section 71 of the Act and register the same if the said property is not in list of prohibited properties for registration as per Section 22-A of the Registration Act and also if the same is in order as per provisions of Indian Stamp Act and Registration Act and the Rules made thereunder. In any case, if the 3rd respondent wants to refuse to register the same, he shall record reasons and communicate the same to the parties. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
