THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.4863 of 2002 ORDER :
This writ petition is filed to declare the proceedings in ROC No.EB1/12/TTDEB/97 dated 05.12.2001, issued by the General Manager, the T.T.D Employees Co-op. Bank Ltd., Tirupati, ordering recovery of Rs.21,853.50 Ps., from the petitioner out of Rs.1,21,595/- directed to be recovered from 13 persons including the petitioner, as illegal and the same may be set aside.
Learned counsel for the 4th respondent raised an objection that the writ petition is not maintainable, as the 4th respondent does not fall within the definition of Article 12 of the Constitution of India. Learned counsel for the petitioner states that the petitioner may be given liberty to avail appropriate remedies as available under law. In view of the above submissions, the writ petition is not maintainable. Accordingly, it is dismissed. However, the dismissal of the writ petition will not preclude the petitioner from availing appropriate remedies available to him under the law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand dismissed.
