HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 41605 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, Standing Counsel for third respondentCorporation. With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself. There is no necessity to put the unofficial respondents on notice as this Court is not venturing to adjudicate the issue on merits.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents 2 and 3 in not demolishing the illegal and un-authorised constructions made at Plot No.37 admeasruing 500 square yards situated in Sy.No.80, Marthanda Nagar, New Hafeezpet, Serilingampally, Hyderabad, in spite of the representation made by the petitioner dated 03.10.2018, as illegal and arbitrary.

3) The grievance of the petitioner appears to be that though a representation was made on 03.10.2018, till date the same is not considered.

4) Learned Standing Counsel for the third respondentCorporation would submit that if the said application is still pending consideration, the authorities may be directed to consider the said representation in accordance with law.

5) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the third respondent to dispose of the representation dated 03.10.2018, in accordance with law, as expeditiously as possible, if the same is made and still pending consideration. There shall be no order as to costs. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
