THE HON'BLE SRI JUSTI CE T.SUNI L CHOWDARY CRIMINAL PETITION No.9946 of 2017 ORDER:
This criminal petition is filed by accused Nos.1 to 4, under Section 438 of Cr.P.C., seeking bail in Crime No.186 of 2017 on the file of the Station House Officer, Srikakulam Rural Police Station, registered for the offence punishable under Sections 324, 323, 379 read with 34 of IPC. 2.
The learned counsel for the petitioners submitted that the purpose of filing the present criminal petition in so far as accused Nos.1 and 2 has become infructuous, as they were arrested by the Police. He further submitted that petitioner Nos.3 and 4 are intending to surrender before the trial Court and the trial Court may be directed to dispose of the bail application filed by petitioner Nos.3 and 4 on the same day. In view of the said submission, this Court is not inclined to go into the merits of the main case.

Taking into consideration the facts and circumstances of the case, the learned Additional Judicial Magistrate of First Class, Srikakulam, is hereby directed to dispose of the bail application filed by petitioner Nos.3 and 4-accused Nos.3 and 4, on their surrender, on the same day in accordance with law.

With the above observation and direction, the criminal petition is disposed of.
