THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN And THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Writ Petition No.18058 of 2016 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) The proceedings under challenge in this writ petition is the assessment order in VAT Form-305 dated 22.03.2016 for the tax period 01.03.2010 to 31.03.2010 and 01.08.2010 to 31.12.2010. The said order is under challenge viz., on the ground that the objections put forth by the petitioner were not even considered and that the impugned order is bereft of reasons. While we were initially inclined to admit the writ petition and grant stay, Sri M.Govind Reddy, learned Special Standing Counsel for Commercial Taxes, would fairly state that instead of keeping the writ petition pending on its file, this Court may consider remanding the matter to the assessing authority to pass reasoned order afresh.

We consider it appropriate, in such circumstances, to set aside the impugned order of assessment and remand the matter to the assessing authority who shall, after giving the petitioner an opportunity of a personal hearing, pass a fresh order, in accordance with law, assigning reasons. The writ petition stands disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of.
