This Writ Petition is filed questioning the order dated 22.12.2016 passed in R.P.No. 10 of 2008 by the Regional Joint Commissioner & Vigilance Officer, Endowments Department, Hyderabad, the 2nd respondent herein, confirming the order dated 05.12.2007 in O.A. No. 923 of 2003 passed by the Deputy Commissioner, Endowments Department, in terms of Section 83 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987, holding the petitioner as an encroacher of the property belonging to Sri Lakshminarayana Swamy Devasthanam, Somasundaram Street, Secunderabad. Today, when the matter is taken up for hearing, learned counsel for the petitioner has placed before this Court a copy of the affidavit of the petitioner undertaking to vacate the premises, if six months' time is granted. Learned Government Pleader for Endowments as well as learned Standing Counsel for the 5th respondent Devasthanam submit that they have no objection for granting the time sought for.
Accordingly, the Writ Petition is disposed of, confirming the order dated 22.12.2016 of the 2nd respondent in R.P. No. 10 of 2008, however, subject to the condition that the petitioner shall be allowed to continue in the subject premises for a period of six months, in terms of the undertaking affidavit filed before this
Court today. The petitioner shall therefore, vacate the subject premises on or before 31.07.2017.
It is made clear that violation of the undertaking would amount to committing the contempt of orders of this Court. No costs.
Consequently, the miscellaneous Applications, if any shall also stand disposed of.
