A.S.No.701 of 2016 is filed by the appellant/ defendant No.7, under Section 96 of CPC, challenging the judgment and decree, dated 11.04.2016, passed in O.S.No.36 of 2010, by the V Additional District Judge at Karimnagar.

I.A.No.4 of 2017 (ASMP No.2344 of 2017) is filed by the appellant, seeking permission of this Court to withdraw the appeal. 3 .

Heard. Perused the record.

A perusal of the affidavit filed in support of the subject I.A.No.4 of 2017 reveals that the dispute between the parties was settled outside the Court, on certain terms. Under these circumstances, I.A.No.4 of 2017 (ASMP No.2344 of 2017) is allowed, according permission to the appellant to withdraw the appeal. 5 .

Consequently, A.S.No.701 of 2016 is dismissed as withdrawn. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this appeal, shall stand closed.
