THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40876 OF 2016 ORDER:
The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the third respondent in not registering the crime basing on the complaint, dated 29.10.2016 and reminder dated 02.11.2016, submitted by the petitioners against the respondents 4 to 8 and their henchmen, as illegal and arbitrary, and consequently, to direct the third respondent to register the crime against the respondents 4 to 8 and investigate the same. Heard and perused the material.
Learned counsel for the petitioners submits that the petitioners lodged the complaint, dated 29.10.2016 and 02.11.2016, and that the third respondent is not registering the complaint of the petitioners and as such, he prays this Court to direct the third respondent to register the case against the respondents 4 to 8 and take action against them. Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the third respondent to register the complaint of the petitioners if it discloses any cognizable offence, and conduct effective investigation and file final report, if any, in accordance with law.
