THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.11153 OF 2017 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in unregistered Crime dated 10.11.2017 of Pendurthi Police Station, Vishakapatnam for the offences punishable under Sections 498-A Indian Penal Code (for short "I.P.C.") and under Sections 3 and 4 of Dowry Prohibition Act, 1961.

Learned Public Prosecutor representing the State brought to the notice that the crime is unregistered and the Court cannot pass any order to quash the proceedings. However, it is the duty of the concerned investigating authority to follow guidelines formulated by the Apex Court in "Rajesh Sharma v. State of U.P.1" In view of the direction issued by the Apex Court, respondent No.1 is directed to follow the guidelines issued by the Apex Court in "Rajesh Sharma v. State of U.P." (referred supra). Accordingly, police concerned are directed to adhere to the guidelines issued in "Rajesh Sharma v. State of U.P." (referred supra). With the above direction, the criminal petition is disposed of. No costs.

Consequently, miscellaneous petitions pending, if any, shall also stand closed.
