THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 10015 OF 2017 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'Cr.P.C.') to quash the proceedings in crime No. 44 of 2017 of Sodam Police Station, Chittoor District, registered for the offence under Sections 420, 341 and 506 read with Section 34 I.P.C., on various grounds. 2.

After arguing the case for awhile, learned counsel for the petitioners requested this Court to direct the concerned S.H.O. to follow the procedure under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar Vs. State of Bihar and another1. 3.

Acceding to the request of learned counsel for the petitioner, the Station House Officer, Sodam Police Station, Chittoor District, is directed to follow the procedure under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar (supra).

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
