THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6695 OF 2016 ORDER:

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit the Petitioners prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 3 and 4 in repeatedly insisting the petitioners to appear before their authority and vacate from the petitioners' respective agricultural landed properties admeasuring Ac.0.37 cents each in Survey Nos.

78/A and 78/P situated in Maddi Revenue Village of Padmanabham Mandal in Visakhapatnam District, as illegal, irregular, irrational, without any authority of law and violative of articles 14 and 21 of the Constitution of India and consequently direct the respondents not to interfere in any manner with petitioners' personal liberty and their possession over said landed properties and pass such other orders or order as this Hon'ble Court may deem fit and proper in the circumstances of the case." Written instructions dated 10.03.

2016 were furnished by the Inspector of Police, Padmanabham Police Station, Visakhapatnam City, to the office of the learned Government Pleader for Home, wherein he stated that as on date, no complaint had been received either against the petitioners or at their behest on the file of the said police station and therefore, the question of calling them to the police station did not arise. The Inspector further denied all the allegations leveled by the petitioners as to interference by the police authorities. The afore-stated stand of the police authorities is taken on record. In the light thereof, no adjudication is warranted in this case on merits.

Sri Ambati Srinivas, learned counsel representing Sri Nimmagadda Satyanarayana, learned counsel for the petitioners, is also agreeable to the closure of the case recording the stand of the police authorities.
