Petition filed under Section 438 of Cr.P.C. praying that in the circumstances stated in the petition and grounds thereof, the High Court may be pleased to enlarge the Petitioners/Accused on Anticipatory Bail in the event of his arrest in connection with F.I.R.no. 273 of 2017, on the file of the P.S. Bommuru, Rajamahendravaram Urban.
The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri N. Vijay, Advocate for the Petitioners and the Addl. Public Prosecutor(AP) for the Respondent-State, the Court made the following ORDER :- "Heard learned counsel for the petitioners/accused and learned Additional Public Prosecutor for the respondent State, and perused the record. This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner/accused in Crime No.273 of 2017 of Bommuru Police Station, Rajamahendravaram Urban, for the offences punishable under Sections 448, 427, 188 and 109 IPC read with Section 34 IPC. Learned Additional Public Prosecutor, on instructions, would submit that petitioner No.1-Nethala Syamala Usha, petitioner No.2-Smt.P.Lakshmi Tulasi and petitioner No.5-K.Satyakala stand deleted in this case as there was no material evidence against them.
The accusation against the petitioner Nos.3 and 4 is similar to the accused B.Ravindra Kumar and others. The said B.Ravindra Kumar and others were granted bail by this Court vide order dated 09.11.2017 in Crl.P.No.10590 of 2017. Therefore, the petitioner Nos.3 and 4/A.14 and A.13 are entitled for bail under Section 438 Cr.P.C. Contd.2...
- 2 - In the result, the Criminal Petition is allowed, directing the petitioner Nos.3 and 4/A.14 and A.13 to surrender before the Station House Officer, Bommuru Police Station, Rajamahendravaram Urban, East Godavari District, within 15 days from the date of this order. On such surrender, the said Station House Officer shall enlarge the petitioner Nos.3 and 4/A.14 and A.13 on bail on each of them executing a personal bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction. The petitioners shall abide by the conditions mentioned in Section 438(2) Cr.P.C. and cooperate with the investigation."
