The Hon'ble Dr.Justice Shameem Akther Criminal Petition No.10767 of 2017 Order:

This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioner/accused No.3, seeking anticipatory bail in the event of his arrest in connection with Crime No.50 of 2017, on the file of S.R.Puram Police Station, Chittoor District, registered for the offences punishable under Sections 420, 468, 471 r/w 34 IPC.

Heard the learned Counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondent- State and perused the record.

The allegation against the petitioner is that he is tampering the records relating to the lands in Survey Nos.429/2B, 429/2C, 291/2 and 447 situated at Thatimkulapalli Village. The Tahsildar of the said Village lodged a report with the Police based on a newspaper report. dated 24-07-2017.

The learned Counsel for the petitioner would submit that the petitioner is a Village Revenue Officer and a law abiding person and that if he is arrested and remanded to judicial custody, there is every likelihood of his suspension from service. The learned Public Prosecutor opposed for grant of bail to the petitioner.

Dr.SA, J Crl.P.No.10767 of 2017 Dt: 14-11-2017 As per the records placed before this Court, this petitioner along with the computer operators and other persons is involved in tampering the records, fabricating the documents relating to 1-B and adangals and issuing false pattadar pass books. Earlier Crime No.6 of 2007 was registered in the same Police Station against this petitioner. The allegations leveled against him are also grave and serious in nature. The matter requires thorough investigation. In the event of granting bail, the petitioner would meddle with investigation of the case and disappearance of evidence and would create hurdles in the collection of material evidence. Under these circumstances, it is not appropriate to grant anticipatory bail to him.

Hence, the Criminal Petition is dismissed.
