THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 10042 OF 2017 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'Cr.P.C.') to quash the proceedings in crime No. 418 of 2017 of P.M. Palem Police Station, Visakhapatnam, registered for the offence under Sections 447 and 427 IPC, on various grounds.

After arguing the case for awhile, learned counsel for the petitioner requested this Court to direct the concerned S.H.O. to follow the procedure under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar Vs. State of Bihar and another1. 3.

Acceding to the request of learned counsel for the petitioner, the Station House Officer, P.M. Palem Police Station, Visakhapatnam, is directed to follow the procedure under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar (supra).

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
