Heard learned counsel for the petitioner/A.1 and learned Additional Public Prosecutor for the respondent State, and perused the record.
This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioner/A.1 in Crime No.25 of 2017 of Chinturu Police Station, East Godavari District, for the offence punishable under Section 8(c) read with 20(b)(ii)(c) of NDPS Act. The petitioner/A.1 was remanded to judicial custody on 07.03.2017. As per the records placed before this Court, 300 kgs of ganja was seized from the possession of A.1 and others. The same was being transported by lorry bearing No.AP16 TY 1193. The date of remand of the accused to judicial custody is not the criterion. The quantity seized is a commercial quantity. Under these circumstances, the gravity of offence is high, the petitioner/A.1 is not entitled for bail. Therefore, the trial Court is directed to complete the trial in S.C.No.160 of 2017 and pronounce the judgment, preferably, within six months from the
date of receipt of this order. With this direction, the Criminal Petition is disposed of.
