HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12949 OF 2016 O R D E R :

Heard learned counsel for the petitioner and learned Standing Counsel for respondents.

This Court on 19.04.2016 granted interim order which reads as follows;

"The petitioner's electricity service connection shall be restored forthwith, on condition of the petitioner paying 1/3rd of the total demand. However, the payment, which is directed to be made, is subject to the final assessment that may be made, pursuant to the provisional assessment notice dt.31.03.2016 issued by the 2nd respondent. The respondent authorities shall complete the final assessment within eight (8) weeks from the date of receipt of a copy of this order. It is made clear that the final assessment order that may be passed by the respondent authorities shall be subject to further rights of the petitioner."

Learned Standing Counsel for respondents submits that in similar circumstances this Court disposed of WP.No.27781 of 2017 on 21.08.2017 and the same is not disputed by the learned Counsel for the petitioner.

In view of the above and for the reasons alike, this writ petition is disposed of directing the respondents to refer the

matter to the Special Court for determination of civil liability of the petitioner and till such determination, the interim order granted on 19.04.2016 continues. No order as to costs.
