Heard learned counsel for the petitioners/A.1 to A.3 and learned Additional Public Prosecutor for the respondent State, and perused the record.
This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioners/A.1 to A.3 in Crime No.68 of 2017 of Kota Police Station, SPSR Nellore District, for the offences punishable under Sections 341, 354(1), 323 IPC read with Section 34 IPC and Section 3(1)(r)(s) SC and ST (POA) Act, 2015. Having argued for sometime, learned counsel for the petitioner submits that he intends to withdraw the criminal petition.
There is a specific mention in the material on record that the petitioners/A.1 to A.3 abused the de facto complainant in the name of caste. There is a bar under Section 18 of SC and ST (POA) Act to grant anticipatory bail, the gravity of offence is high. It is not a fit case to allow this petition.
