This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused No.1, for grant of bail in connection with Crime No.24 of 2017 on the file of the Mothugudem Police Station, East Godavari District, registered for the offences punishable under Sections 8(c) read with 20 (b) (ii) (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act).

Heard the learned counsel for the petitioner/ accused No.1, learned Additional Public Prosecutor representing the respondentState and perused the record. 3 .

Earlier bail application of this petitioner/ accused No.1 was dismissed by the Court below, by order, dated 05.10.2017 passed in Crl.M.P.No.1568 of 2017. It is alleged that 200 kilograms of Ganja was being transported by a Mahindra Verito Car bearing registration No.AP 36 AS 3951 and the petitioner/ accused No.1 is said to be the driver of the said car. The allegations are grave. The quantity of Ganja seized is of commercial quantity. Therefore, the petitioner/ accused No.1 is not entitled for bail at this stage. 4 .

The Criminal Petition is, accordingly, dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
