Through Station House Officer, Prathipadu P.S., East Godavari District. .....Respondent/ Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the petition filed herein, the High Court may be pleased to pass an Order by enlarging the Petitioner herein on bail in Crime No.92 of 2017 of Prathipadu P.S., East Godavari District in the interests of Justice and impose as such other condition or conditions.

The petition coming on for hearing, upon perusing the Petition filed in support thereof and upon hearing the arguments of Sri Chandra Sekhar Ilapakurti, Advocate for the petitioner and of the learned Additional Public Prosecutor (AP) for the respondent-State, the Court made the following ORDER:

"This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.6, for grant of bail in connection with Crime No.92 of 2017 on the file of the Prathipadu Police Station, East Godavari District, registered for the offences punishable under Sections 8(c) read with Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard the learned counsel for the petitioner/accused No.6, learned Additional Public Prosecutor representing the respondent-State and perused the record.

As per the prosecution case, the petitioner/accused No.6 is alleged to have arranged a lorry bearing registration No.HR 38 Q 2642 said to have been owned by the accused No.3 for transporting Ganja. No Ganja was seized from the possession of the petitioner/accused No.6 in this case. Having regard to the nature of allegations, the petitioner/accused No.6 is entitled to be released on bail.

- 2 - Accordingly, the petitioner/accused No.6 is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties in a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Prathipadu, East Godavari District. The Criminal Petition is, accordingly, allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed."
