Petition filed under Section 438 of Cr.P.C. praying that in the circumstances stated in the petition and grounds thereof, the High Court may be pleased to direct the Station House Officer, Kandukur Town Police Station, Prakasham District, Andhra Pradesh, to enlarge the petitioner/A3 on bail in the event of his arrest in pursuant to Crime No. 150 of 2017 of Kandukur Town Police Station, Prakasham District, Andhra Pradesh.
The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri V.V. Lakshmi Narayana, Advocate for the Petitioner and the Addl. Public Prosecutor(TS) for the Respondent-State, the Court made the following ORDER :- "This Criminal Petition is filed by the petitioner/A.3 under Section 438 of Cr.P.C. to grant him anticipatory bail in Crime No.150 of 2017 of Kandukuru(T) Police Station, Prakasam District, registered for the offences punishable under Sections 435 and 379 I.P.C.

Heard the learned counsel for the petitioner-A.3, and the learned Additional Public Prosecutor appearing for the respondent-State, apart from perusing the material available on record.

As per the first information report, the petitioner-A.3 and two other persons are suspected for commission of the offence in this case. As per the report given by the de facto complainant, there are no direct witnesses to the alleged offence. A.2 was granted regular bail by the trial Court. Under these circumstances, it is a fit case to grant anticipatory bail to the petitioner-A.3 under Section 438 Cr.P.C.

In the result, the petitioner-A.3 is directed to surrender before the Station House Officer, Kandukuru (T) Police Station, Prakasam District, within a period of 15 days from today, in Crime No.150 of 2017. On such surrender, the Station House Officer, Kandukuru (T) Police Station, Prakasam District, shall release the petitioner-A.3 on bail on petitioner-A.3 executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the same S.H.O. On release, the petitioner-A.3 shall abide by the conditions mentioned in Section 438(2) Cr.P.C. and cooperate with the investigating officer. The petitioner-A.3 shall also attend before the Station House Officer, Kandukuru (T) Police Station, on every Sunday between 9-00 a.m. and 10-00 a.m. till filing of the charge sheet. Contd.2..
