This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.1, for grant of bail in Crime No.211 of 2018 of Haliya (Alwal) Police Station, Nalgonda District, registered for the offences punishable under Sections 309, 498-A and 302 read with 109 of IPC. 2.

Heard the learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

The learned counsel for the petitioner/A.1 would contend that the petitioner is an innocent person. She was mentally and physically harassed by her husband. She is not responsible for the death of her minor children.

The learned Additional Public Prosecutor opposed the grant of bail to the petitioner/A.1 and ultimately, prayed to dismiss the petition.

At this stage, the learned counsel for the petitioner/A.1 wanted to withdraw the petition. The material placed on record discloses that the petitioner had thrown her three children into NSP left canal at Haliya and caused their death. She also made an attempt to commit suicide but was saved by passersby. The allegations are specific and grave. She is not entitled for bail under Section 438 Cr.P.C.
