THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.MP.No. 11457 OF 2017 IN/AND CRIMINAL PETITION NO.10297 OF 2017 ORDER:

CRL.P.MP.No. 11457 OF 2017 This criminal petition is filed under Section 320(1) of Cr.P.C seeking permission to compound the offences and quash the proceedings in Sessions Case No.20 of 2017 on the file of Special Sessions Judge for Trial of offences under Scheduled Castes and Scheduled Tribes (POA) Act, 1989, Rajahmundry, East Godavari District.

The petitioner/defacto complainant and the respondents 1 to 3 herein are present and they are identified by their respective counsels and produced Photostat copies of Aadhar cards to prove their identity.

The petitioner/defacto complainant and the first respondent are the wife and husband and some disputes arose between them during their marital life.

A joint memo of compromise is filed by both, when terms of compromise are explained in vernacular language, they are admitted to be true and correct and when terms of joint memo of compromise are explained in Telugu language, they are admitted to be true and correct. Further, it is now submitted that, both the petitioner/defacto complainant and the first respondent voluntarily entered into compromise with the petitioners due to intervention of elders and well-wishers and they wanted to lead peaceful life.

MSM,J CrlP_10297_2017 Therefore, I find that the compromise is voluntary in the interest of both parties and permission is granted to compound the offence. Hence, compromise is recorded in terms of the joint memo filed along with this petition. Accordingly, the petition is ordered.
