HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41495 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 2 and 3, in attempting to demolish the petitioner's property admeasuring 236.44 sq. yards, situated at M.C.No.22-2-227, Dabeerpura, Devdi Nawab Farkhunda Yar Jung, Hyderabad, as illegal and arbitrary and violation of the provisions of the Greater Hyderabad Municipal Corporation Act, 1955. It is to be noted that earlier a similar Writ Petition No.38855 of 2018, was filed against the respondents 2 and 3 herein for not taking any steps against the unauthorized constructions made by the petitioners herein. By an order dated 30.10.2018, this Court directed the respondents 1 and 2 therein to deal with the representation dated 19.10.2018, made by the petitioner therein seeking to remove the unauthorized constructions in the subject premises, in accordance with law after hearing all concerned.

The grievance of the petitioner appears to be that the authorities are trying to demolish the structures raised in the subject property, without issuing any notice and the same is opposed by the learned Standing Counsel for the respondents 2 and 3 saying that the question of trying to demolish the structures without following due process of law, does not arise; that if any action is sought to be taken, it shall only be in accordance with the procedure established under law.

Having regard to the above, the writ petition is disposed of directing the respondents 2 and 3 to follow due process of law, if any

action is sought to be taken against the subject property of the petitioner. No order as to costs.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _________________________ C. PRAVEEN KUMAR,J Date:16.11.2018.
