This petition is filed by the petitioner seeking to direct the 2nd respondent to release 2000 kgs of black jaggery seized in Crime No.58 of 2016.

Heard and perused the material available on record. 3.

It is stated that the petitioner purchased 2000 kgs of black jaggery from wholesaler and he loaded the same in a Mini Van and when the said vehicle reached Gangavaram, the 2nd respondent intercepted the vehicle and registered the above case under Section 34(e) of the A.P. Excise Act. It is the contention of the learned Counsel for the petitioner that the jaggery is not prohibited item.

Considering the facts and circumstances of the case, the 2nd respondent is directed to release 2,000 kgs of jaggery seized in the above crime to the petitioner on condition of his executing a personal bond for a sum of Rs.24,000/- (Rupees Twenty Four Thousand only) with one surety for the like sum to the satisfaction of the 2nd respondent. However, this order does not preclude the 2nd respondent concerned from proceeding with the confiscation proceedings initiated, if any. 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 1st December, 2016 Nn
