Between:

Chinthala Venkata Narasimha Rao, s/o. Kotaiah, Aged about 48 years, occu: Fisherman, r/o. Edupalli village, Nagaram Mandal, Guntur district and others.

.....Petitioners and The State of Andhra Pradesh, rep.by its Prl.Secretary to Government, Panchayat Raj Department, Secretariat, Velagapudi, Amaravathi, Guntur district and others.

.....Respondents The Court made the following:

ORDER:

Petitioners were granted leasehold rights for fishing operations in Edumallamma tank, Devanthota tank, Kondai tank and Smasanam tank, respectively, for the year 2017-18. This period was over. Separate auction notices were issued and auctions were conducted and auction was knocked in favour of highest bidders. After auction proceedings are finalized, petitioners were served notices to vacate the village tanks mentioned above. Challenging the same, this writ petition is filed. 2.

Admittedly, leasehold rights granted to petitioners expired and they are not the successful auction purchasers in the subsequent auction conducted and lease was finalized in favour of prospective auction purchasers. Therefore, at this stage, no direction as sought for by the petitioners can be granted even after expiry of lease granted to them. There is no merit in the writ petition and is accordingly dismissed. Pending miscellaneous petitions shall stand closed.
