THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33897 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to direct respondent Nos.1 to 3 herein in general and respondent No.3 in particular to complete the investigation in F.I.R. No.110 of 2014 within the time frame which may be fixed by this Court and to file charge sheet in the said F.I.R. against respondent No.4 herein by declaring the inaction on the part of the respondent Nos.1 to 3 as being violative of the provisions of Articles 14 and 19 of the Constitution of India as well as the principles of natural justice or in the alternative, to direct respondent Nos.1 to 3 herein to handover the investigation in F.I.R.No.110 of 2014 on the file of Central Crime Station Police Station, Hyderabad to the C.B.C.I.D. for the purpose of investigation and taking further necessary action in the matter.

Heard and perused the material available on record. 3.

Case of the petitioner is that even though some serious allegations are made against respondent No.4 and the F.I.R. was registered in the year 2014, respondent No.3 is not investigating the case in accordance with law.

Learned Assistant Government Pleader for Home informed this Court that respondent No.3 is proceeding in proper perspective and he is investigating the matter in all aspects.

Considering all the facts and circumstances of the case, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent No.3 is hereby directed to complete the investigation in F.I.R. No.110 of 2014 as expeditiously as possible, preferably, within a period of six (6) months from the date of receipt of a copy of this order and file final report in accordance with law. 6.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
