Parthasaradhi Reddy Petitioner (Accused No.3 in Cr.No.207/2014 of Mangalagiri Town P.S., Guntur Dist) AND The State of Andhra Pradesh, through Station House Officer (SHO), Mangalagiri Town Police Station, Guntur District, rep. by Public Prosecutor, High Court of Judicature at Hyderabad.

Respondent/Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to grant anticipatory bail to the petitioner in the event of arrest in crime No. 207 of 2014 of Mangalagiri Town Police Station, Guntur District, Andhra Pradesh in the interest of justice. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Hari Sreedhar, Advocate for the Petitioner and of the Addl. Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:

" This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-A3 for the offences alleged under Sections 419, 465, 468 and 471 r/w 34 IPC IPC.

Heard learned counsel for the petitioner-A3, learned Additional Public Prosecutor representing the State and perused the record. 3.

As per the record, the petitioner-A3 said to have purchased the house site under a registered document believing the tile and ownership of his vendor. He has no knowledge with regard to the earlier transaction with regard to the subject property.

Under these circumstances, the petitioner-A3 can be enlarged on bail under Section 438 Cr.P.C.

In the result, the Criminal Petition is allowed directing the petitionerA3 to surrender before the Station House Officer, Mangalagiri Town Police Station, within 15 days from the date of this order. On such surrender, the said S.H.O. shall release the petitioner-A3 on bail on petitioner executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each in a like sum to his satisfaction. On release, the petitioner-accused shall abide by the conditions mentioned under Section 438 (2) Cr.P.C. and co-operate with the Investigating Officer."
