It is the case of the petitioners 1 to 28 that they are the owners and possessors of house bearing No.9-146, 9-247/1, 9-248, 9-248/1, 9-125/4, 9-125/1, 9-125, 9-124, 9-146, 9-252, 9-241, 9-16, 9-115, 8252, 8-253, 8-254, 9-13,9-12, 9-9, 8-253, 9-7, 8-260, 8-260/1, 8-298, 9-1/2, 8-203, 8-303 and 8-297 respectively of Yerrabalem village, Guntur Rural Mandal, Guntur District. They have constructed houses by paying tax to the Gram Panchayat-5th respondent. However, without issuing any notice or without following the due process of law, the respondent authorities are trying to evict the petitioners. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.
Learned Assistant Government Pleader for Revenue, on instructions, submits that the petitioners are all encroachers of government land and that before evicting the petitioners, they will follow due process of law.
In view of the submission of the learned Assistant Government Pleader for Revenue, this writ petition is disposed of directing the respondents not to evict the petitioners from the subject houses, without following due process of law.
There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stands closed.
