State Of Andhra Pradesh, v. V.O. Venugopal Reddy,
HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH PRESENT THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT APPEAL No.66 OF 2016 DATED: 03.02.2016 Between:
State of Andhra Pradesh and others ... Appellants and V.O.Venugopal Reddy ... Respondent
THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT APPEAL No.66 of 2016 PC: (per the Hon'ble The Acting Chief Justice Dilip B. Bhosale)
Heard learned counsel for the parties.
This appeal is directed against the order, dated 01.07.2015 passed in Writ Petition No.16030 of 2015 filed by the respondent. Respondent, in the Writ Petition prayed for mandamus declaring refusal order, passed by the Sub-Registrar, in registering the document in question, as illegal and void.
We are informed that the document has already been registered and the Joint Sub-Registrar, Chandragiri while registering the document before him made the following endorsement: "Note: This document is admitted as per orders of the Hon'ble High Court of Judicature at Hyderabad for the State of Telangana and Andhra Pradesh in W.P.Nos.16026, 16029, 16030 and 16062 of 2015 dt. 1-7-2015. This Registration shall not affect the rights of Government and shall be subject to further orders that may be passed by the revisional authority in the pending revision." We are informed that the revision is pending where the State Government has challenged grant of patta in favour of the vendor of the respondent.
In view thereof, it is obvious that the registration of the document would be, as has been rightly endorsed by the Joint Sub-Registrar, subject to outcome of the revision. Moreover, in view of the judgment of the Full Bench in W.A.No.343 of 2015 and batch dated 23.12.2015, it is always open to the appellants to take appropriate remedy, if they so desired and advised for appropriate relief. Keeping all these options open, the writ appeal is disposed of. Consequently, miscellaneous petitions pending, if any, also stand
disposed of.
