The case of the petitioner is that he is landless poor, belonging to Scheduled Caste and eking out his livelihood through Kerosene dealership. He made an application to the 2nd respondent-District Collector in Prajavani vide No.61067 dated 20.04.2015 for allotment of the land to an extent of Ac.1-68 cents which is in his occupation. The 2nd respondent directed the 3rd respondent-Tahsildar, Anakapalli mandal, to look into the matter. The 3rd respondent obtained report from the Mandal Surveyor and Village Revenue Officer, Sampatipuram, confirming the possession and enjoyment of the petitioner over the subject land.

The grievance of the petitioner is that though he made a representation to the respondent authorities on 28.10.2016 and also on 27.02.2017 reiterating his request for allotment of the above site, the respondent authorities instead of favourably considering his application basing on the report of Mandal Surveyor and the Village Revenue Officer, started interfering with his peaceful possession. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader.

In the facts and circumstances of the case, the 2nd respondent-District Collector, Visakhapatnam, is directed to consider and dispose of the representation dated 27.02.2017 made by the petitioner in accordance with law within six weeks from the date of receipt of a copy of this order. Till such time, status quo shall be maintained with regard to possession of subject land. The writ petition is accordingly disposed of. No costs.
