THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL REVISION CASE No.2959 of 2017 ORDER:
Questioning the condition imposed in the order, dated 03.11.2017, in Crl.M.P.No.92 of 2017 in Crl.A.No.138 of 2017 passed by the learned II-Additional District & Sessions Judge, Hindupur, requiring the revision petitioner to deposit Rs.1,50,000/-, out of the total compensation amount of Rs.4,00,000/-, when the learned Sessions Judge intended to suspend the sentence of imprisonment, the present Criminal Revision Case is preferred. Heard Sri P. Narahari Babu, learned counsel for the petitioner. Though, the learned counsel for the petitioner tried to impress upon this Court by referring to an order of this Court passed earlier, now it is very well settled that 1/4th of the compensation amount is to be paid when suspension of sentence is granted. Therefore, instead of depositing Rs.1,50,000/-, the revision petitioner shall deposit Rs.1,00,000/-, which accounts for 1/4th of the total compensation amount of Rs.4,00,000/-, by 04.12.2017. Only to this extent, the order under challenge is modified.
The present Criminal Revision Petition is, accordingly, disposed of.
As a sequel thereto, miscellaneous petitions if any pending in the present revision cases, stand closed.
