HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17424 OF 2016 O R D E R :

The case of the petitioner is that he made an application on 25.04.2015 before the 3rd respondent for grant of pahanies and pattadar pass books in respect of the his land bearing Sy.No.359 to an extent of Ac.5-00 guntas situated at Kanergaon Village, Wankidi Mandal, Adilabad District stating that he has been in possession of the said land for the last 60 years. But so far no orders are passed by the 3rd respondent on the application filed by the petitioner on 25.04.2015. Hence, the present writ petition is filed.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue submits that pattadar pass books cannot be issued to the subject land as it belongs to forest land.

When the application is pending before the 3rd respondent, it is for the 3rd respondent to dispose of the same as per law. Since the petitioner has not filed the application in form 6-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act') for issuance of pahanies and pattadar pass books, petitioner cannot have any grievance in not disposing of his application. Learned counsel for the petitioner submits that the petitioner would file an application in form 6-A of the Act.

In view of the submission made by the learned counsel for the petitioner, it is for the petitioner to make an application for issuance of pahanies and pattadar pass books in appropriate format as per the provisions of the Act within a period of three (03) weeks from today and on such application being filed by the petitioner, the respondents 2 and 3 are directed to dispose of the same on merits in accordance with law. This Court has not expressed any opinion on merits of the case.

Subject to the above, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ______________________________ A.RAJASHEKER REDDY, J 07.06.2016 dv
