HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 1 5 7 1 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Station House Officer, Chebrolu P.S., West Godavari District, dated 30.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "In reply to para 3 of the affidavit, it is submitted that Mudunuri Tirupathi Raju from whom the petitioner stated to have received fish feed five years back and cleared the outstanding and he has no dues payable to him, has of the approached the respondent Police and not given any report against the petitioner till the date. The Police are not acting at his behest and not summoning the petitioner. The Police are not pressurizing the petitioner and not directing him to settle the accounts with the said person.

It is denied that if the petitioner did not settle his accounts with the said Mudunuri Tirupathi Raju, the petitioner would be implicated in false criminal case. It is also denied that the Police have abused the petitioner in filthy language. It is false to state that due to the acts of the Police, the petitioner is suffering from physical and mental agony.

In reply to para 4 of the affidavit, it is submitted that the 3rd respondent is not summoning the petitioner to his office inasmuch as there is no complaint received or crime registered against him till the date. The allegation that the 3rd respondent is misusing his powers in orally summoning the petitioner to the Police Station without serving any notice on him is false, baseless and denied. It is

submitted that the 3rd respondent is not misusing his power and not summoning the petitioner.

In reply to para 5 of the affidavit, it is submitted that the 3rd respondent is not interfering in civil disputes muchless between the petitioner and the alleged person Mudunuri Tirupathi Raju. As stated above, the said Mudunuri Tirupathi Raju has not given any report with the 3rd respondent against the petitioner herein till the date and the respondent Police are also not calling the petitioner or interfering in civil disputes.

It is submitted that if the respondent Police receives any complaint against the petitioner herein, appropriate action will be taken on the same, by following due process of law."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Station House Officer, Chebrolu P.S., West Godavari District, dated 30.11.2018.
