THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.41554 of 2018 ORDER:

The petitioners are aggrieved by the order dated 23.10.2018 passed by the Joint Collector, Bhadradri-Kothagudem District, in POT Revision Petition No.2 of 2017, whereby he reversed the order dated 16.08.2017 passed by the Revenue Divisional Officer, Kothagudem, in POT Appeal No.5 of 2017.

Sri P.V.Ramana, learned counsel, entered appearance for the sixth respondent, who was the revision petitioner in POT Revision Petition No.2 of 2017. He would point out that against the order sought to be challenged, further revision is provided to the Government. He would place reliance upon BODUGU PURNACHANDRASEKHARA RAO V/s. GOVERNMENT OF A.P.1, wherein a learned Judge of the Andhra Pradesh High Court at Hyderabad took note of this aspect. In the light of the efficacious alternative remedy provided to the petitioners, it is not open to them to circumvent the same and approach this Court by way of a writ petition. Further, the scope of enquiry in a statutory revision would be far wider than that which can be undertaken by this Court in a writ petition filed under Article 226 of the Constitution. The writ petition is accordingly dismissed leaving it open to the petitioners to invoke the alternative remedy available to them in accordance with the due procedure.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
