HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.41615 of 2018 O R D E R:

This writ petition is filed challenging the action of the 2nd respondent in issuing the endorsement vide R.Dis.No.F4/1/22(A)/Lands/VLP/2018, dated 09.08.2018 rejecting the application of the petitioner for deletion of land to an extent of 2.02 acres in S.No.53/2B and 3.40 acres in S.No.53/2C of Jarravaripalle Village, Valmikipuram Mandal, Chittoor District, from the list of prohibited properties under Section 22-A(1)(e) of the Registration Act, 1908. Learned counsel for the petitioner submits that even according to impugned endorsement the subject land is assigned prior to 1954 and in the endorsement it is also stated that the decision with regard to 'assigned lands prior to 1954' is pending at Government level. He also submits that the Government has issued G.O.Ms.No.575, dated 16.11.2018 ordering for deletion of Government lands assigned prior to 1954 from the purview of Section 22-A of the Registration Act, 1908.

The same is not disputed by the learned Assistant Government Pleader for Revenue.

The fact that the lands assigned prior to 1954 is also admitted in the written instructions produced by the learned Assistant Government Pleader.

In view of the aforesaid facts and circumstances, the impugned endorsement is set aside.

Accordingly the writ petition is allowed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 22.11.2018 tk
