HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 41577 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 2nd respondent in not considering the representation of the petitioner dated 02.11.2018, seeking to cancel construction permission granted by the 3rd respondent in file No.3006/ 11592/ 2018, dated 26.04.2018, as illegal, arbitrary and improper.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent to consider the representation dated 02.11.2018 made by the petitioner, seeking to cancel construction permission granted by the 3rd respondent in file No.3006/ 11592/ 2018, dated 26.04.2018.

The learned Standing Counsel would submit that if the representation made by the petitioner is still pending consideration, the authorities shall deal with the same in accordance with law.

Recording the same, the present writ petition is disposed of, directing the 2nd respondent to deal with the representation made by the petitioner on 02.11.2018, seeking to cancel construction permission granted by the 3rd respondent in file No.3006/ 11592/ 2018, dated 26.04.2018, in accordance with law, after hearing all concerned, and pass orders as early as possible,

preferably, within a period of six to eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
