This Criminal Petition, under Sections 437 and 439 of Cr.P.C., is filed by the petitioner/sole accused, seeking regular bail in Crime No.28 of 2017, on the file of the Station House Officer, Vemula Police Station, Kadapa District, registered for the offence punishable under Section 302 IPC. Heard the learned Counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondentState and perused the record. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and that he is falsely implicated in this case.
As per the First Information Report, on 28-03-2017 around 12.30 in the midnight, the petitioner/accused was found beating his mother with iron rod. The neighbour, who intervened and called the rest of the neighbours to protect the victim, lodged the report.
Dr.SA, J Crl.P.No.10681 of 2017 Dt: 13-11-2017 The allegation against the petitioner/accused is that, in a drunken state, he beat his mother and caused her death as she was willing to give away certain property to her daughter. In view of gravity of the offence alleged against the petitioner and as there are direct witnesses to the alleged commission of offence, the release of petitioner would hinder the trial and there is every likelihood of the petitioner/accused winning over the witnesses. Under these circumstances, it is not appropriate to release the petitioner on bail.
Hence, the Criminal Petition is dismissed.
