Shaik Tanveer Raza Tahir v. The State Of Telangana
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.12309 OF 2018 ORDER:
1.
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner/accused, in an un-registered Crime before the Station House Officer, Cyber Crime Police Station, Cyberabad Commissionerate. 2.
Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the 1st respondent-State, and perused the record. 3.
Learned counsel for the petitioner submits that although no crime is yet registered against the petitioner, earlier he was arrested and was brought on P.T. warrant. Learned counsel further submits that some more complaints are lodged against the petitioner and that whenever he is attending the concerned Police Station to comply with the conditions, he is being threatened that he is going to be arrested soon with regard the other complaints lodged against him. Hence, the learned counsel seeks for grant of anticipatory bail to the petitioner. 4.
Considering the above, this Court opines that it would suffice, if a direction is given to the Police concerned to follow Section 41-A of Cr.P.C. 5.
Accordingly, the Criminal Petition is disposed of with a direction to the Police concerned to follow Section 41-A of Cr.P.C. before affecting the arrest of the petitioner/accused.
6.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
