THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8295 OF 2016 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 is filed by the petitioner/accused seeking to grant bail in Crime No.189 of 2016 on the file of Medchal Police Station, Medchal, Ranga Reddy District, registered for the offences punishable under Sections 417 and 420 I.P.C. and Section 3(1)(s) and W(i) of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Amendment Act, 2015.

2. Heard and perused the material available on record.

3. The allegation against the petitioner is that he made the de facto complainant pregnant before marriage and when she insisted him for marriage, he abused her in the name of her caste and later, he married her, but after marriage, he vacated the house and his whereabouts are not known and thus, he cheated her.

4. Learned Additional Public Prosecutor opposed the bail application by submitting that there is a bar for grant of bail to the petitioner under the provisions of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Amendment Act.

5. In view of the submission of the learned Additional Public Prosecutor, this Court is of the view that this is not a fit case to grant anticipatory bail to the petitioner.
