SMT JUSTICE T.RAJANI CRIMINAL PETITION No.12298 OF 2018 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioner/Accused No.1 seeking a direction to the II Additional Judicial Magistrate of First Class, Kurnool, to dispose of the C.C. No.126 of 2016, as expeditiously as possible.

Heard learned counsel for the petitioner and learned Public Prosecutor, appearing for the respondent - State.

Learned counsel for the petitioner submits that this case was being transferred from Court to Court and, hence, it was not coming up for trial. Learned counsel further submits that, initially, it was instituted in the Court of Judicial Magistrate of First Class, Kurnool and, subsequently, transferred to the Court of Special Judicial Magistrate of First Class for Prohibition and Excise, Kurnool, and, now, it is transferred to the Court of II Additional Judicial Magistrate of First Class, Kurnool.

Hence, considering the above, including the fact that the case pertains to the year 2016, this Court opines that a direction need to be given to the learned II Additional Judicial Magistrate of First Class, Kurnool, to dispose of the C.C. No.126 of 2016, as expeditiously as possible, preferably within a period of four
(4) months, from the date of receipt of a copy of this order. 5.
Accordingly, with the above observation, the Criminal Petition is disposed of.

As a sequel, miscellaneous petitions if any, pending in this Petition shall stand closed.
