ORDER:

Petitioner claims to be one of the members of the Mustafa Rose Land Co-operative Housing Society Limited. The substantive grievance of the petitioner as seen from the averments in the affidavit filed in support of the writ petition would show that unilaterally and even without holding elections, the Executive Body was declared as elected on 20.11.2013 for a period of five years. As the tenure of five years is coming to an end, the petitioner alleges that the 4th respondent is going to follow the same procedure as earlier announce executive committee without conducting elections and holding general body meeting. Petitioner also alleges that the welfare of the society is not taken care of by the 4th respondent.

However, the representation submitted by Khaja Bagh Residents Welfare Association is entirely different. The prayer sought in the writ petition is to take action against the members of the Executive committee of the 4th respondent against corrupt practices. It is not clear from the reading of the affidavit that how Khaja Bagh Residents Welfare Association is concerned with the 4th respondent society and the averments are silent as to how the alleged illegalities have taken place by the Executive Committee of the 4th respondent society. The affidavit is also silent as to availing the

appropriate remedies against the members of the 4th respondent society on the allegation of illegal elections in Nov, 2013 and on the alleged illegalities taken place in functioning of the society.

Having regard to the above, this Court is not inclined entertain the writ petition. Accordingly, the writ petition is dismissed, leaving it open to the petitioner to work out the remedies available in law. There shall be no order as to costs. As sequel to it, Miscellaneous Petitions, if any pending, shall stand dismissed.
