K. Ravi Kumar v. The State Of Telangana
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.12297 OF 2018 ORDER:
1.
This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioner/Accused No.4 seeking to quash the proceedings in P.R.C. No.37 of 2016, pending on the file of the Court of XIV Additional Chief Metropolitan Magistrate, Hyderabad, registered for the offences punishable under Sections 370 and 370A of I.P.C. and Sections 3, 4, 5 and 7 of the Immoral Trafficking (Prevention) Act, 1956.
2.
Heard learned counsel for the petitioner and learned Public Prosecutor, appearing for the respondent - State.
3.
Learned counsel for the petitioner submits that, the Petitioner/A-4 though was stated to be a customer, charge sheet shows that he was simply present in the premises and that he was not a customer.
4.
However, considering the fact that the charge sheet was also laid against the petitioner, this Court opines that this is not a fit case to quash the proceedings against the petitioner. Hence, the Criminal Petition is liable to be dismissed.
5.
In the result, the Criminal Petition is dismissed. 6.
As a sequel, miscellaneous petitions if any, pending in this Petition shall stand dismissed.
