HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 1 8 1 6 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Chirala I (T) Police Station, Prakasam District, dated 20.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the petitioner herein had lodged a complaint on 31.05.2018 with the 4th respondent Station House Officer, Chirala I Town Police Station, Prakasam District with regard to cheating and criminal breach of trust by one Peddisetty Susheel Kumar and one Krishna Mohan Reddy Vice President, A.P.Cine Workers Cooperative Housing Society Ltd., and others.

It is submitted that pursuant to the said complaint, the 4th respondent Station House Officer, Chirala I Town Police Station, Prakasam District, had enquired into the matter and revealed that there was a civil dispute between the petitioner and Peddisetty Susheel Kumar and one Krishan Mohan Reddy, Vice President, A.P.Cine Workers Cooperative Housing Society Ltd., and others with regard to Flat No.M.6.110, Prakasam District. As the matter relates to civil in nature, hence the 4th respondent suggested the petitioner to approach concerned civil Court for redressal. In this connection, entry was made into the General Diary and also informed the same to the petitioner by way of notice on 20.11.2018 and the petitioner acknowledged the same.

It is pertinent to mention here that the petitioner purchased the property under an agreement either oral or written by paying amount. Hence, the dispute is civil in nature. The petitioner tried to use Police as tool to settle the civil dispute. It is submitted that the contention of the petitioner against the respondents are incorrect and baseless. It is submitted that the Writ Petition is devoid of merits and liable tobe dismissed."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of

Police, Chirala I Town Police Station, Prakasam District, dated 20.11.2018, leaving it open for the petitioner herein to avail the remedies open, in accordance with law..
