THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4664 OF 2016 ORDER:

This petition is filed by the petitioner-owner of the property seeking to quash the docket order dated 14.3.2016 passed in Crime No.202 of 2015 on the file of the I Additional Chief Metropolitan Magistrate, Visakhapatnam.

The petitioner filed a petition under Section 451 Cr.P.C. in the above Crime seeking interim custody of the seized property viz., house bearing No.4-45-13/3, Third Floor of Vijayanagar Colony, Peda Waltair, Visakhapatnam. The learned Magistrate returned the said petition. Aggrieved by the same, the petitioner filed this petition. Heard and perused the material available on record. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The petitioner is directed to file a fresh application before the Court concerned for return of the property by adding necessary parties as respondents.

On such application being filed, the Court concerned is directed to conduct an enquiry and pass appropriate orders, in accordance with law, after hearing all the parties." Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
