Learned counsel for the petitioner/accused seeks permission to withdraw the Transfer Criminal Petition with liberty to file an application for dispense with the appearance of the petitioner before the trial Court.

Permission, as sought for, is accorded.

Accordingly, the Transfer Criminal Petition is dismissed as withdrawn giving liberty to the petitioner file an application under Section 205 Cr.P.C., or under Rule 37 of the Criminal Rules of Practice and Circular Orders of A.P., and in the event of filing of the application, the learned Magistrate is directed to pass appropriate orders thereon.
