It is the case of the petitioners that since the time of their ancestors, they are in enjoyment of lease of different small parcels of land in an extent of Ac.066 cents, Ac.0-45 cents, Ac.0-50 cents, Ac.0-53 cents respectively inSurvey No.360, an extent of Ac.4-00 cents out of Ac.10-50 cents of Chamadala village, Jaladanki mandal, SPSR Nellore District, ever since 1980 and subsequently they occupied remaining Ac.6-50 cents. Taking into consideration their community, poverty and socio economic conditions, Government has granted lease to the ancestors of petitioners. Petitioners are in possession and cultivating the land granted on lease by the Government. The Government also recognized their possession by entry of their names in Revenue records. The petitioners are socially and economically backward, downtrodden and poor and they have no other means of livelihood, and that the lease deeds given to their ancestors are lost.

It is the grievance of the petitioners that the respondents are trying to dispossess the petitioners from the aforestated lands, without following due process of law.

Heard the learned counsel for the petitioners, and the learned Assistant Government Pleader.

Learned Assistant Government Pleader produced written instructions and submitted that the petitioners are encroachers and the subject land is classified as "Kunta Poramboku" as per the RSR of Chamadala Village, and therefore no assignment can be granted.

In view of the above facts and circumstances, it is open for the respondents to follow due process of law before dispossessing the petitioners. With the above direction, the writ petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand closed. _____________________ A.
