THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 41722 of 2018 ORDER:

It is the case of the petitioners that since the time of their ancestors, they are in enjoyment of lease of different small parcels of land in an extent of Ac.0-30 cents, Ac.1-40 cents, Ac.0-70 cents, Ac.0-06 cents, Ac.0-15. Ac.0-10 cents, Ac.0-05 cents, Ac.0-15 cents, Ac.0-05 cents, Ac.0-24 cents, Ac.0-05 cents, Ac.0-55 cents and ac.0-10 cents respectively in Sy.No.389 (Sy.NO.389/1 an extent of Ac.5-27 cents and Sy.No.389/2 an extent of Ac.1-96 cents) total extent of Ac.7-23 cents of Chamadala village, Jaladanki mandal, SPSR Nellore District, ever since 1980. Taking into consideration their community, poverty and socio economic conditions, Government has granted lease to the ancestors of petitioners. Petitioners are in possession and cultivating the land granted on lease by the Government.

The Government also recognized their possession by entering the names of petitioners in revenue records. The petitioners are socially and economically backward, downtrodden and poor and they have no other means of livelihood, and that the lease deeds given to their ancestors are lost. It is the grievance of the petitioners that the respondents are trying to dispossess the petitioners from the aforesaid lands, without following due process of law. Hence, the present writ petition.

Learned counsel for the petitioners submits that in similar circumstances, this Court disposed of WP.No.41648 of 2018 by its order dated 19-11-2018.

Learned Assistant Government Pleader produced written instructions, which are similar to the one in that writ petition.

In view of the same, for the reasons alike in the said order, this writ petition is also disposed of. It is open for the respondents to follow due process of law before dispossessing the petitioners.
