Respondent Counsel for the Petitioner :
Mr. C.Sharan Reddy Counsel for the Respondent: ---- The Court made the following:
CVNR,J Date:23.11.2018 Order:
This civil revision petition is filed against order dated 24.09.2018 in I.A.No.868 of 2018 in O.S.No.40 of 2018 on the file of the X Additional District and Sessions Judge, Anakapalli. 2.
At the hearing, Mr.C.Sharan Reddy, learned counsel for the petitioner submitted that the lower court has committed a serious error in attaching the property on the same day i.e. 26.09.2018, on which day it has passed an order, directing the petitioner to furnish security within 48 hours, failing which the property shall be attached. 3.
Though prima facie the submission of the learned counsel appears to be correct, however, in view of the fact that the lower court has subsequently re-called the warrant in view of the petitioner submitting security, I do not find any reason to adjudicate the civil revision petition on merits.
4.
The civil revision petition is accordingly disposed of, however, permitting the petitioner to file an application for vacating order dated 24.09.2018 before the lower court.
5.
As a sequel to the disposal of the civil revision petition, I.A.No.1 of 2018 is disposed of as infructuous. __________________________________ (C.V.Nagarjuna Reddy, J) Date: 23rd November, 2018 msb
